Overview
It depends on how the estate passes: through probate, through a living trust, or as a small estate. Here is what each one means for the house.
The funeral was Saturday. On Monday your brother calls: he has a free week and a borrowed pickup, and he wants to start clearing out Mom’s house. Before anyone carries out a dresser, one question needs an answer: who has the legal right to do it?
Families often call us the week after a funeral, ready to clear the house. Sometimes that is fine. Sometimes the person calling doesn’t yet have the legal right to remove anything. Here is how California sorts that out. This is general information, not legal advice. For a specific estate, talk to a California probate or estate planning attorney. This guide is part of our Sacramento estate cleanout series.
The short answer depends on which of three routes the estate takes:
- Probate: no one can administer the estate until letters issue (Probate Code 8400). A named executor can secure and insure the house now; clearing it waits for letters.
- Living trust: if the house was titled in the trust, the successor trustee can generally clear and sell it without probate, and must notify beneficiaries and heirs within 60 days (Probate Code 16061.7).
- Small estate: up to $208,850 for deaths on or after April 1, 2025, after a 40-day wait. The house usually needs a separate procedure.
If the Estate Goes Through Probate
California Probate Code 8400 says no one has the power to administer an estate until the court appoints them and issues letters: letters testamentary for a named executor, letters of administration otherwise. That includes the executor named in the will.
Before letters issue, a named executor may pay funeral expenses and take the steps needed to maintain and preserve the estate, such as securing the house and keeping it insured. Emptying the house, selling belongings or giving them away generally waits until letters issue. The statute text is on FindLaw’s copy of Probate Code 8400.
If the House Is in a Living Trust
If the house was titled in the name of a living trust, the successor trustee named in the trust can generally manage and sell it without a probate case, and that includes clearing it out. The trustee also has to notify the beneficiaries and heirs within 60 days under Probate Code 16061.7.
One catch: a trust only controls property that was actually transferred into it. If the deed is still in your parent’s own name, the trustee may need a court order before acting. Check the deed before you plan the cleanout.
If It Is a Small Estate
For deaths on or after April 1, 2025, California’s small estate procedure covers estates up to $208,850, after a 40-day wait, according to the Sacramento County Public Law Library. The house itself usually needs a separate procedure, so ask before assuming the small estate route covers it.
What You Can Usually Do Right Away
- Lock up, change the locks, and keep the insurance and utilities on.
- Search for the will, the trust and other papers (see our document checklist).
- Move small valuables, firearms and medications to safekeeping, and list what you moved.
- Throw out perishable food and obvious household trash.
- Photograph every room. It helps with any inventory the court or the beneficiaries ask for.
When You Are Clear to Proceed
Once you have letters, or you are the acting successor trustee, you can plan the cleanout. We often schedule around a listing date or a court deadline, and we work from a lockbox when the executor lives out of town. Our estate cleanout service page shows how the day runs, and there is a separate guide to clearing a Sacramento house from out of state.
