Selling a Hoarder House in Sacramento: Clear It First or Sell As-Is?

A hoarded house can be sold in almost any condition. The question is what the condition costs you. An investor will buy it full and as-is, at a discount that covers their risk. Option 1: Sell As-Is, Contents and All

Cash buyers and investors will make an offer on a house they can barely walk through. It is fast and requires nothing from you. The trade-off is price: the buyer can’t see the floors, walls or plumbing, so they assume the worst and price it in, along with the cost of the cleanout. Buyers using ordinary mortgages are usually out, since lenders and appraisers need a home that can be inspected and lived in.

Option 2: Clear It, Then Decide

Emptying the house does two things. It lets you, an agent and an inspector see what you actually have. And it turns the property back into something a regular buyer can tour and finance. Often the damage under the piles is less than feared: floors that need refinishing, not replacing.

After clearing, you still have a choice between selling as-is in empty condition, or cleaning and repairing before listing. A local agent can tell you which repairs pay for themselves.

How to Compare the Two

• Get an as-is cash offer, or an agent’s estimate of one.
• Get an agent’s estimate of the price once the home is cleared and cleaned.
• Get a written cleanout quote (most hoarding projects run $2,000 to $10,000 or more; see hoarder cleanout cost), plus cleaning and any urgent repairs.
• Add the cost of holding the house for the extra weeks: mortgage, taxes, insurance, utilities.
• If the gap between the two prices is larger than those costs, clearing it first wins.

What You Must Disclose

Selling as-is does not mean selling without disclosure. California’s Transfer Disclosure Statement law, Civil Code 1102, applies to most home sales and says any waiver of its requirements is void. Some transfers are exempt under Civil Code 1102.2, including sales ordered by a probate court and sales by a fiduciary administering a trust or a decedent’s estate, with exceptions. Even an exempt seller is still bound by the general duty not to conceal known problems: section 1102.8 says the law does not limit any disclosure obligation that exists to avoid fraud, misrepresentation or deceit.

In plain terms: if you know about a roof leak, pest damage, mold or unpermitted work, say so. If the owner died in the home, Civil Code 1710.2 says there is no duty to disclose a death that happened more than three years before the offer, but a seller may not misrepresent it when asked directly.
