Hoarding and Code Enforcement in Sacramento: What Happens After a Report

A notice from code enforcement is often what finally forces a hoarding situation into the open. It is alarming, but the process is slower and more forgiving than most people expect, and the first notice usually costs nothing if you act on it. This is general information, not legal advice. What Counts as a Violation

Mostly, what can be seen from outside. Sacramento City Code 8.04.100 makes it a public nuisance to accumulate junk, appliances, furniture, containers, rubbish and debris on a property within view of neighbors or the street. The unincorporated county has near-identical wording.

Inside the house, the standard is state law. Health and Safety Code 17920.3 lists conditions that make a building substandard when they endanger occupants, neighbors or the public: infestation of insects, vermin or rodents; an accumulation of junk, debris, garbage and combustible materials; fire hazards; and inadequate exits.

Can Inspectors Come Inside?

Not without your consent, an emergency or a warrant. Sacramento County’s own page on hoarding says code officers and police cannot enter a home unless there is clear danger. If an owner refuses, an agency can ask a judge for an inspection warrant under Code of Civil Procedure 1822.50 and the sections that follow, which generally require that consent was sought and refused, and 24 hours’ notice before the inspection.

The Process in the City of Sacramento

The city code sets administrative penalties from $100 to $25,000 per violation depending on the level, and each day can count separately. The large numbers are for serious or long-ignored cases; the point is that the first notice is the cheap moment to act.

• Someone reports the property through 311.
• The city sends a Notice of Alleged Violation. Its published process gives the owner 21 days to correct the problem.
• If it is corrected, the case is closed and no fees are due.
• If not, an inspector visits and may issue a Notice and Order. From here fees and administrative penalties are charged against the property.
• Unpaid costs can become a special assessment recorded against the property. The city holds a hearing for owners with financial hardship.

The Process in Unincorporated Sacramento County

The county follows a similar path: an advisory Notice of Alleged Violation with a time frame to fix the problem, then an inspection, then a Notice of Violation with a new deadline. County code gives 30 days to correct housing violations, or 5 if there is an imminent hazard. Its published fee schedule lists an initial inspection fee of $470, a re-inspection fee of $335 and administrative penalties of up to $1,000 per violation per day, and says the owner is charged for all county costs if the county has to do the cleanup itself. If It Goes Further

For a building that stays substandard after notices, Health and Safety Code 17980.7 lets the agency ask a court to appoint a receiver to take control of the property and make the repairs at the owner’s expense. Courts consider whether the owner had a reasonable opportunity to correct the conditions. It is rare, and it follows a long record of ignored notices.

How to Respond to a Notice

• Read it for the specific violations and the deadline. Don’t ignore it.
• Call the officer named on the notice. Explain the situation and ask what must be done first.
• If you can’t finish in time, ask for an extension in writing and show progress: photos, a booked cleanout date.
• Start with what the notice lists, which is usually the yard, driveway and porch.
