Overview
The unit has gone past messy into unsafe, and the tenant may be protected by fair housing law. Here are the entry rules, accommodations, notices and cleanup steps that apply, for Sacramento landlords and property managers.
The complaint from next door mentions a smell. When you finally get in for a scheduled repair, the hallway is a single-file path between stacked boxes, the back door will not open, and there are roaches on the kitchen counter. You have a duty to keep the building safe. You also have a tenant who may be ill, and who may be protected by fair housing law. Move too fast and you take on legal risk. Wait too long and you keep the safety risk.
This is the general shape of the California rules, in the order you will usually meet them. It is general information, not legal advice; for a specific situation, talk to a California attorney. This guide is part of our Sacramento hoarder cleanout series.
Clutter Alone Is Not a Violation
A tenant may live with far more belongings than you would, and that alone breaks no rule. What the law requires is narrower. Under Civil Code 1941.2, a tenant must keep the part of the premises they occupy clean and sanitary and dispose of rubbish and garbage properly. The problems you can act on are specific: blocked exits, pests, rotting garbage, items stored against a heater or water heater, damage to the unit, or risk to neighbors.
Write down what you see in exactly those terms, with dates and photographs. “Unit is messy” will not hold up. “Rear exit blocked floor to ceiling, roaches in kitchen” will.
Getting In to Look
You cannot inspect whenever you like. Civil Code 1954 limits entry to listed purposes, such as an emergency, necessary or agreed repairs, and showing the unit. There is no general right of inspection. For anything other than an emergency you must give written notice, and 24 hours is presumed reasonable (six days if mailed). Enter during normal business hours.
Fair Housing: Hoarding Can Be a Disability
Hoarding disorder is a recognized mental health condition. A mental impairment that substantially limits major life activities can qualify as a disability under the federal Fair Housing Act and California’s Fair Employment and Housing Act. If it does, the tenant can ask for a reasonable accommodation.
California’s regulations say a request can be made at any time, including during an eviction case (2 CCR 12176), and the landlord has to consider it. In practice the accommodation is usually time: a written cleanup plan with dates and re-inspections, instead of an immediate notice to quit.
There are limits. A landlord can deny an accommodation that would be an undue financial and administrative burden. A landlord can also deny one where the tenancy poses a direct threat to the health or safety of others, or would cause substantial physical damage to others’ property. That has to be judged by an individualized assessment based on objective evidence (2 CCR 12179). Get legal advice before you rely on those exceptions.
A Sensible Order of Steps
- Document the specific health and safety problems.
- Talk to the tenant, and put the problems and what must change in writing.
- Offer a cleanup plan with realistic dates. Ask whether a family member, case worker or therapist can be involved.
- Re-inspect on the agreed dates, with proper notice each time.
- If nothing changes and the problems are serious, speak to an attorney about formal notices.
Notices and Eviction
Many California tenancies of 12 months or more fall under the Tenant Protection Act, Civil Code 1946.2, which requires just cause to end a tenancy. Some single-family homes and newer buildings are exempt. At-fault causes that can apply here include breach of a material lease term, nuisance and waste. For a violation that can be cured, the owner must first give written notice and an opportunity to cure.
The three-day notice to perform or quit comes from Code of Civil Procedure 1161. The three days exclude weekends and court holidays.
The City of Sacramento has its own Tenant Protection Program (City Code chapter 5.156), covering many older multi-unit buildings, with its own notice-to-cease requirement. Check which rules apply to your property before you serve anything.
After the Tenant Leaves
Belongings left behind are not automatically yours to throw out. Civil Code 1983 requires a notice giving the former tenant at least 15 days to claim them if delivered in person, or 18 days if mailed. Under Civil Code 1988, if the property is reasonably believed to be worth less than $700, you may keep or dispose of it after that; otherwise it goes to public sale.
The numbers in this guide, in one place:
| Rule | Number | What it means |
|---|---|---|
| Civil Code 1954 (entry) | 24 hours | Written notice presumed reasonable for non-emergency entry; six days if mailed |
| Code of Civil Procedure 1161 | 3 days | Notice to perform or quit, not counting weekends and court holidays |
| Civil Code 1983 (belongings) | 15 days | Minimum time to claim belongings when the notice is delivered in person; 18 days if mailed |
| Civil Code 1988 (value) | $700 | Worth less: keep or dispose of it after the claim period; otherwise public sale |
Once the waiting period has run, our hoarder cleanout service can clear the unit so cleaners and repair trades can get in. We haul household contents. We do not take biohazard waste, and we do not do the cleaning. For budgeting, see hoarder cleanout cost in Sacramento, and for the hazards worth documenting, hoarding fire and safety hazards.
